Supreme Court and Trump

The arguments to decide if Trump's candidacy can be denied ballots in States to start this week.

I hate to ruin this exciting moment for those that steer their lives according to whatever current thing pop culture is telling you to pay attention to, but this issue was decided long ago.
People can and have run for office, including the presidency, from Prison.
So no matter how gassy Trump makes you, the law is still on his side.

Now if you guys decide to take your majority that can't figure out basic biology and change the existing law, that is possible.
But as it stands its just noise.

Of course Trump can run for President, even from prison!

Now try your best and watch the video, before you shoot the messenger, silly. The video is about States ability to remove insurrectionists like Trump from their ballot for the office of President. You people call it States Rights! You know, the same example as Governor Abbott is using in Texas to stop those Mexicans invading their lands or that the Slave Owning States used in 1861.

Are you not for States Rights or are you some type of commie?

100% agree, you can be convicted and serving for murder and still run for president... you just can't have been part of an insurrection. The open question for the courts now are 1) what constitutes an insurrection 2) can states decided for themselves the answer to question 1. There is also a small side argument of 3) Is the presidency technically an office and does it fall under "a member of any State legislature, or as an executive or judicial officer of any State" language in the constitution. So far none of the courts at the state level have given much credence to the argument of 'no' to #3 but in theory the Supreme court could see it differently.

We can all share our opinions on the answer to these but none of us are judges so it's just (another) circle jerk. Claiming the law is 'clear' on the answer to these question is naive. These aren't ideas that have been 'tested' much in the courts at all, and most of the case history that does exist is civil war era or older.

I am assuming based on your comments that you must be a constitution law expert. So you know then what the Fourteenth Amendment, Section 3 reads.

"No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any state, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof But Congress may by a vote of two-thirds of each House, remove such disability."

Disagreeing with someone doesn't require getting snarky about their personal status.

All of us here have some level of knowledge of the things we debate. Most, I believe, are self-taught, some are not. But in the Internet age it really matters very little; someone who never went to school can find online articles that are just as in-depth as anything one might once have had to go to a really good school to find out.
